Regina v. H.M.C. [Provincial Court – June 2014]

HMC, an executive with a multinational corporation, was charged with sexual assault for allegedly groping a waitress during the course of local festivities. HMC, a middle aged married professional with no prior adverse history with the police, denied being anywhere near the waitress or tent in question. None of that seemed to matter to the police. HMC was arrested and charged accordingly.

Bottom Line: Prior to trial Patrick Fagan discovered that the police had engaged in a highly problematic investigative procedure germane to identification of HMC as the suspect. Patrick Fagan was successful in having all charges completely withdrawn.
